TERMS AND CONDITIONS FOR MY RITUALS URBAN SPA GIVEAWAY COMPETITION
• Participants - This giveaway competition is open to participants in the Netherlands aged 18 and older. If you are under the age of 18, you will need proven consent from your parents or guardian to enter. To enter this competition, you will need a valid e-mail address. The only way to enter this competition is digitally, by completing the form for My Rituals membership. All website users who have registered for My Rituals membership during the competition period as described below will be considered ‘Participants’.
The following parties are excluded from participation: (i) employees of Rituals or companies affiliated or associated with Rituals, (ii) every other person who is involved in the organisation of the competition, and (iii) immediate family members of the persons mentioned under (i) or (ii);
• Participation - Participation is free of charge. The competition will run from 1 October 2019 (midnight at the start of the day) up to and including 13 October 2019 (midnight at the end of the day). Participation in this competition will take place exclusively electronically. To be eligible to win a Prize, a Participant must (i) have entered a valid e-mail address and valid personal details and have registered for My Rituals membership prior to midnight at the end of the day on 13 October 2019 and additionally (ii) accepted the Terms and Conditions (general and specifically relating to privacy). If a Participant cancels their My Rituals membership during the course of the competition, this Participant will no longer be eligible to win a Prize.
• Organisation - This competition is organised by Rituals Cosmetics Enterprise B.V., having its registered offices at Keizersgracht 679, 1017 DV Amsterdam, the Netherlands, and registered with the Chamber of Commerce under number 809215160 (hereinafter referred to as the 'Organiser' or Rituals");
• Personal data - The personal data that will be processed in connection with the competition are the personal data that the Participant provides when registering for My Rituals membership. The additional personal data of the Winners (e.g. their address) will only be used by Rituals for the purposes of sending them the Prize. The personal data provided upon participation will be treated by Rituals with strict confidentially and will be retained and/or processed in accordance with the applicable legislation with regard to the protection of personal data in line with our Privacy Policy.
• Changes - Rituals reserves the right to end the promotion at any time and/or unilaterally change the published rules, prizes, promotional period, as well as the Terms and Conditions, at any time without having to provide reasons. In all cases not provided for by these conditions Rituals will decide in accordance with what is reasonable and as it deems fit;
• Winner – On 16 October 2019, Rituals will select the winner of the competition at random from among the Participants who are eligible to win a Prize. Every Participant will be eligible only once to win a Prize. Rituals will contact the winners on 16 October 2019 (by e-mail) with a request to communicate their address details to Rituals to enable Rituals to send them the Prize. The winners are obliged to respond to the notification by e-mail (providing their address) as soon as possible and in all cases before 30 October 2019. Should they fail to do so, they will waive their right to the Prize and Rituals will select an alternative winner. In such a case, the initial winner will not be entitled to claim the Prize, or any other form of monetary or other compensation. Rituals will then send the Prize to the winners within a reasonable term. All prizes under this competition are strictly personal, non-transferable, and non-exchangeable for cash or any other form of compensation. Additionally, Rituals is not obliged to communicate or correspond about the result of this competition.
• Prizes – 5x Duo Spa Treatment worth €150 (€75 per person). The treatment is based on The Ritual of Tsuru: Deep Relaxation Massage (60 minutes). The treatment must be booked in 2019 and will take place in consultation and on the basis of availability at the Urban Spa. The winners can choose from the Urban Spa locations Amsterdam, Almere, and Heemstede. Rituals will cover only the spa treatment itself. Any travel expenses are for the account of the winners. Rituals will contact the winners by e-mail on 16 October 2019. After receiving this e-mail, the winners have one month within which to book the treatment, after which the Prize expires.
• Liability - Except in the case of fraud or a deliberate error, Rituals cannot be held liable for any damage incurred by a Participant as a result of or arising from his/her participation in the competition or receipt or use of the Prize, including but not limited to damage arising from not being able to participate or being excluded from the competition, for whatever reason, and/or the suitability of, a defect in or the non-conformity of the Prize;
• Exclusion – Rituals has the right to exclude a Participant from participation in this competition and therefore from the chance of winning a Prize if the Participant has provided incorrect, incomplete, unclear, or misleading data or has in any other manner committed fraud or attempted to do so. Mass form submissions, participation by or through third parties or associations, macros, or other automated methods, and means of participation in the competition that do not fully comply with the provisions of the Promotional Terms and Conditions will be excluded. If a Participant uses or manipulates a computer system to circumvent the Promotional Terms and Conditions, e.g. through the use of ‘scripts’, manipulation of IP addresses, the use of a third party’s identity or login details, the use of any other automated methods to generate additional registrations to participate in the competition, and any other use that is not in accordance with the spirit of the competition, this Participant and all similar means of participating in the competition will be excluded. In such a case, any allocation of a Prize will be declared null and void.
• Applicable law - This competition is governed by Dutch law, and all disputes in relation to the competition that cannot be settled amicably will be brought exclusively before the competent courts in Amsterdam.
• Applicability of the Terms and Conditions - By participating in the competition, the Participant explicitly accepts these Terms and Conditions.
